PLEASE READ THIS RELEASE OF LIABILITY POLICY ("POLICY") CAREFULLY BEFORE PARTICIPATING IN ANY ACTIVITIES ORGANIZED BY SOBER OUTDOORS, INC. ("COMPANY"). BY USING OUR WEBSITE WWW.SOBEROUTDOORS.ORG ("WEBSITE") OR PARTICIPATING IN OUR ACTIVITIES, YOU ("PARTICIPANT") ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS POLICY. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE WEBSITE OR PARTICIPATE IN OUR ACTIVITIES.
1. Assumption of Risk
1.1 Inherent Risks: Participant acknowledges that outdoor activities, including but not limited to hiking, camping, water sports, and other physical endeavors organized by the Company, involve inherent risks that may result in injury, illness, or death.
1.2 Voluntary Participation: Participation in these activities is voluntary, and the Participant accepts all associated risks, whether known or unknown.
2. Release and Waiver
2.1 Release of Liability: Participant hereby releases and holds harmless the Company, its officers, directors, employees, agents, volunteers, and affiliates from any and all claims, demands, or causes of action arising out of or related to any injury, loss, or damage sustained through participation.
2.2 Covenant Not to Sue: Participant agrees not to initiate any legal action against the Company for claims released by this Policy.
3. Indemnification
3.1 Participant's Responsibility: Participant agrees to indemnify and defend the Company against any claims, damages, or liabilities arising from their actions or omissions during participation.
4. Medical Fitness and Treatment
4.1 Health Certification: Participant certifies that they are physically fit and have no medical conditions that would hinder safe participation.
4.2 Consent to Treatment: In the event of an emergency, Participant consents to receive appropriate medical treatment and accepts responsibility for any associated costs.
5. Compliance with Guidelines
5.1 Safety Rules: Participant agrees to follow all safety instructions and guidelines provided by the Company.
5.2 Equipment Use: Any equipment provided by the Company must be used properly. Participant is responsible for any damage resulting from misuse.
6. Intellectual Property
6.1 Content Ownership: All content on the Website is the property of the Company and protected by applicable laws.
6.2 Limited License: Participant is granted a limited, non-transferable license to access and use the Website for personal purposes.
7. Governing Law and Jurisdiction
7.1 Applicable Law: This Policy shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
7.2 Dispute Resolution: Any disputes arising under this Policy shall be resolved in the state or federal courts located in Denver County, Colorado.
8. Severability
8.1 Invalid Provisions: If any provision of this Policy is found to be unenforceable, the remaining provisions shall remain in effect.
9. Entire Agreement
9.1 Complete Understanding: This Policy constitutes the entire agreement between the Participant and the Company regarding liability and supersedes all prior agreements.
BY PARTICIPATING IN ACTIVITIES OR USING THE WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS RELEASE OF LIABILITY POLICY AND AGREE TO ITS TERMS.
Sober Outdoors Zero Tolerance Policy for Alcohol and Drug Use at Events
Purpose:
To create a safe, welcoming, and supportive environment for all participants, Sober Outdoors strictly prohibits the use or possession of alcohol, drugs, or any mind-altering substances at any Sober Outdoors event or gathering.
Policy:
No Alcohol or Drugs:
Alcohol, drugs, and mind-altering substances are strictly prohibited at all Sober Outdoors events. This includes both recreational and prescription drugs not medically necessary during the event. Attendees must refrain from bringing, consuming, or sharing any substances that could impair judgment, affect sobriety, or disrupt the environment.Zero Tolerance:
Sober Outdoors maintains a zero-tolerance policy toward alcohol and drug use at events. Any participant found in violation of this policy will be asked to exit the event. Efforts will be made to ensure that the participant can leave in a safe and respectful manner, protecting their well-being and the integrity of the event.Promoting a Safe, Inclusive Environment:
This policy is in place to honor and protect the sobriety of all participants, including those in recovery, sober-curious individuals, and allies. It reinforces Sober Outdoors’ mission to provide substance-free gatherings for personal growth, connection, and wellness in a supportive community.Participant Acknowledgment:
All participants must acknowledge and agree to abide by this policy as a condition of attendance. This ensures that everyone respects the commitment to sobriety and understands the importance of maintaining a safe, substance-free environment.
Enforcement:
If a participant is found in violation of the policy, Sober Outdoors event staff or organizers will discreetly and respectfully request that the individual leave the event.
Staff will take appropriate steps to ensure the participant can leave safely.
